REFUND POLICY

ASamplesX primarily sells digital products, including downloadable sample libraries, virtual instruments, MIDI files, MIDI groove libraries, audio loops, software, presets and other digital media.
ASamplesX is a trading brand operated by:

1. DIGITAL PRODUCTS
Our products are digital goods that may become accessible immediately after a purchase is completed.
Depending on the product, delivery may take place through:
a download link;
a customer account;
a download manager;
a licence or activation system;
email; or
another digital-delivery method identified on the product page.
Because a digital product cannot practically be returned once it has been delivered, downloaded, accessed, licensed or activated, purchases are normally final after digital delivery has begun.
However, this does not affect any refund, replacement, repair or other remedy that you are legally entitled to under applicable consumer-protection law.
2. PLEASE CHECK BEFORE PURCHASING
Before purchasing a product, please review the information on the relevant product page, including where applicable:
product contents;
supported formats;
software requirements;
Kontakt requirements;
Kontakt version requirements;
DAW compatibility;
operating-system requirements;
hardware requirements;
storage requirements; and
any required third-party software.
Unless expressly stated otherwise, required third-party software or hardware is not included with your ASamplesX purchase.

3. WHEN A REFUND MAY BE PROVIDED
We will review a refund request where one or more of the following applies:
A. DUPLICATE CHARGE
You were charged more than once for the same transaction.
B. ACCIDENTAL DUPLICATE PURCHASE
You accidentally purchased the same product more than once using the same customer account or identifiable customer information.
C. INCORRECT PRODUCT DELIVERED
ASamplesX delivered a different product from the product you ordered.
D. MATERIAL TECHNICAL DEFECT
The purchased product has a material technical defect that prevents it from functioning substantially as described, and we are unable to provide a reasonable repair, replacement, workaround or other appropriate solution.
E. PRODUCT MATERIALLY NOT AS DESCRIBED
The product materially differs from the description, specifications or contents presented to you at the time of purchase.
F. UNAUTHORIZED OR ERRONEOUS TRANSACTION
A payment was processed in error in circumstances where a refund is appropriate after investigation.
G. LEGAL ENTITLEMENT
A refund or other remedy is required under applicable consumer-protection or other mandatory law.
4. TECHNICAL ISSUES
If you experience a technical problem, please contact us before requesting a refund.
Many issues involving digital music products can result from:
incorrect installation;
incorrect file locations;
unsupported software versions;
missing third-party software;
DAW configuration;
operating-system permissions;
Kontakt configuration;
licensing or activation issues; or
other system-specific circumstances.
Our support team may ask for reasonable information needed to investigate the issue, such as:
your operating system;
DAW and version;
Kontakt version, where applicable;
product version;
screenshots;
error messages; and
a description of the problem.
Where reasonably possible, we will first attempt to resolve a genuine technical problem.
If the product is materially defective and we cannot provide a reasonable solution, we will provide the remedy required by applicable law or otherwise appropriate in the circumstances.
5. SITUATIONS THAT ARE NORMALLY NOT ELIGIBLE FOR A REFUND
Subject always to your mandatory legal rights, a refund will normally not be provided solely because:
you changed your mind after the digital product was delivered or accessed;
you no longer want or need the product;
you purchased the wrong product despite the product being accurately identified before checkout;
you did not review the published product description or system requirements;
you do not own required third-party software or hardware that was clearly identified on the product page;
your computer, operating system, DAW, Kontakt version or other environment does not meet the published requirements;
you expected a feature, instrument, rhythm, sound, format or function that was not advertised as part of the product;
you dislike the artistic character, sound, performance style or subjective qualities of a product that otherwise substantially matches its description;
you later found another product that you prefer;
you were unable to use the product because of an unsupported or modified system configuration;
a third-party product or service changed after your purchase in a way that affects compatibility and the ASamplesX product was compatible with the published requirements at the time of purchase; or
you have already used, redistributed, shared or otherwise exploited the product in violation of its licence.
These exclusions do not apply where mandatory law gives you a right to a refund or another remedy.
6. KONTAKT AND OTHER THIRD-PARTY SOFTWARE
Some ASamplesX products require the full version of Native Instruments Kontakt or another specific third-party application.
Where such a requirement is stated on the product page, purchasing the ASamplesX product does not include that third-party software.
A refund will normally not be issued because a customer:
owns Kontakt Player instead of the required full version of Kontakt;
owns an unsupported Kontakt version;
does not own the required DAW or software; or
uses a system that does not meet the requirements published at the time of purchase.
This applies only where the relevant requirement was accurately disclosed before purchase.
If our published compatibility information was materially incorrect, we will review the case separately.
7. PRODUCT UPDATES AND THIRD-PARTY CHANGES
Software platforms, DAWs, operating systems and third-party applications may change over time.
ASamplesX cannot guarantee indefinite compatibility with every future version of third-party software or hardware.
A later change made independently by a third-party developer does not automatically make an earlier purchase refundable.
Where reasonably practical, we may provide compatibility updates or guidance.
This does not affect any mandatory rights that apply where a product was defective or materially non-conforming when supplied.
8. REQUESTING A REFUND
To request a refund review, contact:

Please provide:
your full name;
order number;
email address used for the purchase;
product name;
date of purchase;
reason for the request; and
any relevant supporting information.
For technical issues, please also provide relevant screenshots, error messages or system information where reasonably necessary.
Providing complete information will help us assess your request more quickly.
9. REVIEW OF REQUESTS
Refund requests are reviewed individually.
We may verify:
the transaction;
payment status;
download or activation status;
licence records;
the product description that applied when you purchased;
technical information relevant to the reported problem; and
previous support correspondence.
We will not reject a refund or other remedy where applicable law requires us to provide one.
10. APPROVED REFUNDS
If a refund is approved, it will normally be returned through the original payment method used for the purchase.
The time required for funds to appear after a refund is processed depends on the payment provider, card issuer, bank or other financial institution.
ASamplesX does not control processing times imposed by third-party financial institutions.
11. LICENCE AND PRODUCT ACCESS AFTER A REFUND
If a purchase is refunded, the corresponding licence, download entitlement, activation or other product-access right may be cancelled.
After receiving a full refund, you must stop using the refunded product and must not continue to use, distribute, copy or access its underlying files except where applicable law provides otherwise.
A refund does not grant permission to retain and continue using the refunded product.
12. PARTIAL REFUNDS
Where appropriate, we may provide a partial refund or another proportionate remedy instead of a full refund.
This may apply, for example, where:
only part of an order is affected;
a bundle contains both affected and unaffected items; or
a partial remedy is appropriate under applicable law.
Any mandatory consumer remedy takes priority over this provision.
13. PROMOTIONAL PRODUCTS, BUNDLES AND DISCOUNTS
Where a refund is approved for a product purchased as part of a bundle, promotion or discounted transaction, the refund may be calculated according to the actual amount attributable to that product in the transaction.
If refunding an item changes eligibility for a bundle or promotional discount, the calculation may take the original promotional structure into account where permitted by law.
Free products have no refundable purchase price.
14. CHARGEBACKS AND PAYMENT DISPUTES
If you believe there is a problem with an ASamplesX transaction, please contact us first so that we can investigate it.
Submitting a fraudulent or knowingly false chargeback may result in suspension of the associated account, licence or download access and may be investigated further.
Nothing in this section prevents you from exercising a legitimate right to dispute an unauthorized or improper transaction through your payment provider.
15. CONSUMER RIGHTS
Nothing in this Refund Policy excludes, restricts or reduces any right or remedy that cannot legally be excluded under applicable law.
In particular, where applicable consumer law gives you a remedy because a product or service is:
defective;
materially non-conforming;
incorrectly supplied;
unsafe; or
otherwise legally deficient,
ASamplesX will comply with the applicable legal requirements.
If any provision of this Refund Policy conflicts with a mandatory consumer-protection rule, the mandatory rule will apply.
16. CHANGES TO THIS REFUND POLICY
We may update this Refund Policy to reflect changes in:
our products;
delivery systems;
payment systems;
business practices; or
applicable law.
The version applicable to a purchase will generally be the policy in effect when the purchase was made, except where a later change is required by law or provides greater rights to the customer.
